Cycling Holidays Booking Conditions

All holidays are provided by Just Pedal Limited (“the Company”, “we”, “our” or “us”) and are sold subject to the following conditions.

Making a Booking
1. Prior to booking please read the brochure description, trip itinerary and these booking conditions. If you have any questions please contact us for clarification.  Please print these conditions and keep a copy for your records.

2. To make a booking you must be over 18 and send us, whether by post or by completing and transmitting a booking form to us electronically, a completed booking form and non-refundable deposit for each person. We will treat each booking form submitted as an offer by you to purchase the holiday package in accordance with these terms and conditions. We will acknowledge receipt of your booking by e-mail. If you notice any errors regarding your booking on this e-mail, please contact us at info@just-pedal.com to correct these. A contract will only be in place between us (all persons named on the booking form) once your deposit has cleared to us and we have issued a confirmation of this. The date on the confirmation will be the date the contract is made.
3.  We will invoice you for the remainder of the cost of your holiday, which you must pay no later than 56 days before departure.  If you book less than 56 days before departure full payment must be made on booking.  If the balance is not paid in time we reserve the right to cancel your holiday and apply the cancellation charges outlined below.

4.  Once a deposit is paid you are deemed to have accepted these terms & conditions whether booking via the Raid.cc or Just-Pedal.com websites or paying direct via bank transfer or Paypal.

Cancellation by you
4.  If you wish to cancel your holiday, this must be done in writing (including by email to info@just-pedal.com) provided that in all instances receipt can be acknowledged by the person who is the first person named on the confirmation issued to you. You will be liable for the following cancellation charges:
4.1  56 days or more before the departure date you will forfeit your deposit;
4.2  More than 28 days and less than 56 days a 20% refund of the holiday price will be made;
4.3  Less than 28 days before the departure date no refund will be given; or
4.4 If the Company requires a lesser sum than set out in 4.1, 4.2 and 4.3 above to cover its reasonable costs and losses caused by the cancellation, it may at its discretion charge you that lesser sum.
5. The Company shall take all reasonable steps to keep its costs and losses to a minimum.

Cancellation by the Company
6.  We may cancel your holiday including in the following circumstances:
6.1 Where circumstances beyond our reasonable control arise, for example, war, civil or political unrest, terrorism, poor weather conditions or technical problems arise with transport; and/or
6.2  The minimum number needed to operate one of our holidays has not been met. We will advise you of this no later than 14 days prior to departure.
7. If we cancel in either of the circumstances described above, we will, if possible, offer an alternative holiday.  If the replacement holiday is of a lower value we will refund the difference in price to you.  If this is not acceptable to you we will refund all payments made to us in respect of your holiday.
8. Please refer to conditions 10 and 11 below relating to insurance. You should utilise your insurance cover for any loss you suffer before requesting or accepting a refund from us.

Transfers
9. If any person is prevented from travelling, we will agree to that person’s booking being transferred to another person who satisfies all the conditions applicable to the holiday, subject to both persons accepting joint and several liability for full payment of the holiday price and our charge for confirming the transfer and any additional costs arising from the transfer.  We must be given reasonable notice of the transfer request, which is considered to be at least 14 days prior to the departure date.

Insurance
10.     Please ensure you have adequate insurance cover for baggage, equipment (including, without limitation and where appropriate, bicycles and helmets intended for your use whether hired or otherwise) medical expenses and the cost of repatriation should you become too ill to continue with your holiday.
11.     There is insurance designed for the type of holidays we recommend you purchase insurance with this type of cover. Any claims concerning matters for which you are insured must be directed to your insurers. It is your responsibility to ensure you arrive at the start of the Just Pedal itinerary within a reasonable time to commence the pre-booked tour, as we cannot refund you outside the terms of our Booking Conditions. If you have booked flights independently, you may wish to consider arranging insurance in addition to the cover granted under our standard travel insurance policy to cover the cost of cancelled itinerary if your airline cancels your flight and you cannot make it to the start of your tour.

Prices
12.     Prices quoted in our brochure, on the website or anywhere else in our literature are a guide only and may change at any time up to the point a contract is made between us.  All prices include VAT at the appropriate rate.  After the contract is made between us we have the right to increase the price of the holiday where the cost to us of providing you with the holiday package increases:
12.1        Due to any change in VAT or any other duties, surcharges or fees levied on your holiday package;
12.2        As a result of a rise in transportation costs; or 12.3        as a result of exchange rate fluctuations.  Any such fluctuations will be calculated in comparison to a base rate of £1 = US$1.561, £1 = Euro 1.191, obtained at 19 December 2011. 13.     We will not make any such increase to the basic cost of your holiday within 30 days of your holiday start date. We will also absorb all such increases where they amount to less than 2% of the total cost of your holiday.  These provisions exclude cancellation charges.  If we have to increase our prices you will be entitled to cancel your booking with us and receive a full refund.

Your Holiday
14.     Your booking is accepted on the understanding that you accept:
14.1        the risks and hazards of such a holiday, including the dangers inherent in cycling on the road, the dangers inherent in the other activities included in our other holidays, and any risks that result from (amongst other things) changes of local politics, adverse weather conditions, the poor condition of the highways, border restrictions, terrorism and disease; and
14.2        The potential for (amongst other things) delays, alterations, loss or damage to property, inconvenience and discomfort.
15.     You should satisfy yourself before booking that you have researched your destination, made an informed decision to travel, and taken all necessary precautions. You can obtain travel advice from the British Foreign and Commonwealth Office.
16.     There is a natural need to be flexible in a holiday of this kind.  The day to day agenda and ultimate aim of the holiday is taken as an objective and not as a contractual obligation.  It is a fundamental condition of booking that you accept this flexibility, and acknowledge that delays and alterations and their subsequent results, such as inconvenience, discomfort, or disappointment, are possible.
17.     If after departure we are unable to provide a significant proportion of the services we had agreed to aim to provide as part of our contract with you, we will act reasonably to make suitable alternative arrangements.
18.     On any of our holidays it is necessary that you abide by the authority of the leader, who represents the Company, and whose decision is final.  Completing our booking form signifies your agreement to this, and if you commit any illegal act when on the holiday or if in the reasonable opinion of the leader your behaviour is causing or likely to cause danger, distress or annoyance to others we may terminate your travel arrangements without any liability on our part.
19.     We cannot guarantee the composition of the group in terms of age, nationality, gender, singles and couples.
20.     Please note that flights and other products you purchase separately do not form part of your holiday package with us.
21.     Travel arrangements to meet or on leaving any tour are your responsibility.  Any guidance we may provide is simply that and must be checked by you.
22.     Our responsibility does not commence until the appointed time at the designated meeting point.  If you fail to arrive there at the appointed time for whatever reason, we will not be responsible for any additional expenses incurred by you to meet up with the group.
23.     Any information given by the Company in regard to climate, clothing, special equipment, topography etc is done so in good faith and must be rechecked by you prior to relying on it.
24.     No refund or compensation will be made or given for any unused hotel accommodation, services or features of the holiday where unused at your discretion or as a result of your action/inaction.

Medical and special requirements
25.     It is your responsibility to ensure that you are sufficiently fit and healthy to complete your chosen holiday.  We reserve the right to require you to produce a doctor’s certificate of fitness to participate in your chosen holiday.  If you are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the holiday, you must advise us before booking.  If you do not do so, we may cancel your holiday at any time.
26.     Preliminary arrangements including passport, travellers cheques, visa procurement are your responsibility.
27.     We welcome people with restricted mobility, medical or particular care requirements or a disability, and aim to ensure that our services are as accessible as reasonably possible to all.  However, in order that we may consider the possibility of making reasonable adjustments, it is important that we are fully informed of any needs, requirements and conditions before any booking is concluded.  Please telephone us and we will be happy to discuss availability, suitability and potential reasonable adjustments with you, including any requirement for you or a member of your party to be accompanied by someone who is able to provide for any particular needs you or they may have, over and above any reasonable adjustments we are able to make.
28.     If you have special requirements a risk assessment might be required prior to confirming a booking or allowing participation in certain activities.  Please note that we rely on the information you provide to help us anticipate and satisfy your needs.  We therefore require you to give us a full and frank description of your needs. You must update us with any change in your circumstances prior to and during your stay.  Our guides can only provide general first aid. As such it may be necessary for you or a member of your party to be able to administer or attend to your/their own medical needs or have someone accompany you/them who can do so.
29.     You should inform us immediately if, within 4 weeks prior to your arrival date or during your break, any member of your party has, or develops, an infectious or contagious medical condition.  If so, we have the right to:
29.1        refuse to accept your booking;
29.2        cancel your holiday; or
29.3        ask any member of your party to leave immediately, should we, at our reasonable discretion, consider it necessary to protect the health of others.

Behaviour
30.     Your behaviour should not be excessive, noisy or disruptive, especially at night. Your behaviour must at all times be appropriate to the culture of the country you are visiting. Offensive or illegal behaviour will not be tolerated and may result in the police being involved.  We do not consider offensive or aggressive behaviour or language towards our staff to be acceptable.  We may ask you and/or any member of your party to leave immediately if your conduct is considered by us to be inappropriate, likely to cause harm, or impair the enjoyment, comfort or safety of your neighbours, other members of your group, staff and the general public, or is likely, in our belief, to breach any terms of our agreement with you.  No refunds or compensation will be given in these circumstances and we reserve the right not to accept any future bookings from you or any member of your party.

Our liability to you
31.     Nothing in these terms seeks to limit or exclude our liability if something we do or fail to do causes death or personal injury through our negligence or if we cause damage to your property and that cause is our fault.  We are also not seeking to exclude or limit our responsibility for loss caused by the services not matching our description of them or our negligent performance of the services.
32. Other than this liability which we have accepted, we will not be liable for any losses that you suffer as a result of any breach of our agreement except those losses which are reasonably foreseeable to both of us at the time we enter into the contract with you.
33. We shall not be held liable for any damages caused by the total, or partial failure to provide your holiday if such failure is:
33.1 attributable to you; or
33.2  unforeseeable or unavoidable and attributable to a third party unconnected with us or any of our sub-contractors; or
33.3 As a result of unusual and unforeseeable circumstances beyond our control including but not limited to strikes, war, civil or political unrest or government action; or
33.4 Due to the theft of bicycles or injury as a result of cycling either on or off road and in particular injuries as a result of either inadequately maintained and serviced personal equipment or failure to wear the correct safety equipment most notably cycle helmets, unless demonstrably due to our negligence.
34 In addition, since the services are provided to you as a consumer, we cannot accept responsibility for any losses related to any business of yours such as lost data, lost profits, loss of business, loss of contracts, loss of goodwill or other business loss that you may incur as a result of any breach of our agreement.
35. We will also not be liable for direct damage or loss of any nature caused, or contributed to, by any defect in or failure (whether partial or complete) of any travel services not provided by us, and which we could not reasonably be expected to be responsible for.
36. Except for those areas for which we do not seek to exclude liability, our total liability to you is limited to twice the basic tour price per person shown on the invoice.

38. Any complaints regarding the holiday should be made to the tour leader and/ or local representative who will normally take the appropriate action.  If at the end of the tour, you feel that your complaint was not dealt with properly and were not satisfied with the response, you must notify us of your complaint in writing within 28 days of the actual completion date of the tour.  We will try to agree a settlement with you.

Information
40.     Please note that all information given about our holidays, whether in our brochure, on our website or otherwise, is intended merely to present a general idea of the holiday. Information is correct to the best of our knowledge. You will be provided with an itinerary for your holiday giving details such as, the type of accommodation used, what is included in the price, passport and visa requirements.  Changes in all of these items may be made at any time and we will notify you of any changes that we become aware of as soon as we are reasonably able to do so.  For most holidays we publish detailed Trip Itineraries which contain up-to-date definitive information about the holiday, and which will be sent on request or can be downloaded from our website.  You should ensure that you are fully aware of the contents of the Trip Itinerary before booking.  In all cases the tour itinerary should be considered as more up to date than the brochure. The information and conditions relating to your holiday (and extension/ options where applicable) contained in the Trip Itinerary will be deemed to be part of the contract, and you should therefore read them carefully.

Safety and Security
41.     Your personal belongings are your own responsibility during your holiday with us. The police have notified us that personal cycles are particularly vulnerable to theft.
42.     Activities which take place out of doors are provided subject to appropriate weather conditions prevailing at the time the activity is to take place.
43.     You must ensure that any activity or facility selected by you or any members of your party is suitable for those who are taking part.
44.     You are required to follow any safety advice provided to you.

Points to consider before booking
45.     You may not bring with you or use any shotgun, knife, firearm, air weapon, archery equipment, fireworks (including sparklers), illegal substances or similar item under any circumstances.
46.     Should you wish to use one of our holidays as a gift, prize, part of a reward programme or other promotion you must contact us before making the booking.  We will detail the special requirements that apply.  By booking you will be deemed to have accepted our special requirements as notified to you.
47.     You may not advertise, use, give or resell your holiday or any discount offer associated with it or offer to do so (for profit or otherwise) or use it in connection with a competition, promotion, business and charitable or any other similar venture without our express advance written permission.

Equipment and Accommodation
48.     Each accommodation provider may have its own terms and conditions on which they accept guests, and you agree to abide by these.
49.     You are expected to use the equipment and facilities provided to you with care and to keep them in a clean and tidy condition.  We reserve the right to charge you for any extra cleaning, missing items or damage.
50.     We reserve the right to enter your accommodation at any time for any reasonable purpose, for example, to make checks, or carry out essential inspection, maintenance work, housekeeping or repairs.  Please note that your occupation is not therefore exclusive.
51.     As we continually strive to improve our facilities and holidays you acknowledge and accept that you may find that:
51.1        new facilities are available;
51.2        listed facilities are temporarily closed for maintenance and/or improvement;
51.3        some facilities have been altered;
51.4        maintenance work or housekeeping tasks are undertaken; and
51.5        different equipment is provided to that described in our brochures or other communications.
52.     If bringing your own equipment on one of our holidays, please ensure that it is adequately maintained and insured.  We will take all reasonable care when transporting equipment, however we are not responsible for any damage caused to equipment by a third party unconnected with the provision of the services contracted for, whether such damage is caused during the holiday or whilst the equipment is in transit.

Compensation payable by you
53.     By booking you agree that we have the right either during or after your holiday to recover from you, either via the credit/charge or debit card used to pay for the holiday or otherwise, the costs of:
53.1        any compensation we may pay to others, including others on the tour, resulting from your acts or omissions; and/or
53.2        any property or accommodation damage; and/or
53.3        any other charges, fees or levies we may incur resulting from your action or inaction and from any breach of these conditions.

General
54.     These booking conditions may only be waived by one of our directors in writing.
55.     These booking conditions are governed by English law and both you and we agree to submit to the non-exclusive jurisdiction of the English courts.
56.     By booking, unless you tell us otherwise, you consent to our use of any likeness or image of you secured or taken on any of our holidays without charge in all media (whether now existing or in the future) for bona fide promotional materials of any kind, such as brochures, videos and the internet.
57.     We may transfer and / or assign its rights and / or its obligations under these booking conditions.  This will not affect your rights under this contract.  You may not transfer any of your rights or obligations under these booking conditions without our prior written consent, which we may not unreasonably withheld.
58.     You are responsible for the supervision of all members of your party under the age of 18.
59.     If either you or we breach this contract and the party not in breach ignores this, the party not in breach will still be entitled to use its rights and remedies at a later date.
60.     If any part of these terms and conditions is unenforceable (including any provision in which our liability to you is excluded) the enforceability of any other part of these terms and conditions will not be affected.
61.     A person who is not a party to this contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract, but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Corporate and Charity events

Just Pedal Limited is committed to a policy of fair-trading.  Our Terms and Conditions have been written as a result of our responsibilities under English law.

1. Your reservation
All bookings are made and accepted subject to the terms set out in these conditions.  We reserve the right to refuse a booking without explanation but will refund any registration fee made.

2. If we change a ride
We plan tour arrangements many months in advance and though it is unlikely we will have to make any changes to confirmed schedule and arrangements, it does happen occasionally.  Most changes are of a minor nature and we will advise you at the earliest possible date.

If we are forced to cancel, or in any way change, your tour due to war, threat of war, riots, civil commotion, industrial disputes, disaster, terrorist activities, adverse weather, technical or other problems with transportation, alteration of cancellation or scheduled services or other events outside our control, we will not be liable for any modification, cancellation, extension or delay in the arrangement.

3. If we cancel a ride
We reserve the right, in any circumstances, to cancel your ride.  However in no case will we cancel your ride less than 6 weeks before the scheduled departure date, except for the reasons detailed in Conditions (2).  If, due to events beyond our control, we are no longer able to provide the ride booked, we will return to you all monies paid, and any amendment charges.

4. Responsibility
Cycling is a potentially dangerous activity.  All persons participating in the ride do so at their own risk and accept that the organisers and any associated charities or companies cannot be held responsible for personal injury, accident, loss, damage or public liability, and by taking part in such activities acknowledge and assume the risks inherent therein save for negligent acts and/or omissions on the part of Just Pedal Ltd, its employees, agents or suppliers, agency or contract of supply, so far as is allowable within the law.

(I) We shall not be responsible nor do we accept liability for death, personal injury or illness caused to you and/or to any named person on the booking form;

(II) You use any transportation arranged by Just Pedal Limited at your own risk;

(III)  We cannot be held responsible for the condition of any route incorporated in a ride;

(IV) Each person who takes part in a ride shall indemnify us against any and all liabilities, claims and costs incurred by or made against us arising out of any act or omission of that person or of the party of which that person is a member; and (VI) We reserve the right to prohibit any person from taking part in a ride who, in our view, is a danger to themselves or to any of the participants on the ride.  In the event that we prevent such a person taking part in any ride pursuant to this sub-clause no refund or compensation whatsoever shall be payable by us.  All persons who participate in a ride are responsible for arranging and paying for appropriate personal insurance cover for the duration of the ride.

5. Customer Service
We aim to ensure that your ride with us is as enjoyable as possible, but if you have a problem during your ride it is important that you advise our representative who will endeavour to put things right quickly.

6. Cancellation by you
If you wish to cancel your booking this must be done in writing by the person and/or company in whose name the booking was made, either via email to info@just-pedal.com or sent by recorded delivery to Just Pedal Limited, 80 Fleet Street, Beaminster DT8 3EH.  In the event of cancellation or part cancellation the following charges will become payable:

Riders
Registration fee is non refundable.

Charities/Companies
Deposit is non refundable

Cancellation charge (including deposit) as a % of total price…

Between 6 and 12 months before departure: 50%.
Between 3 and 6 months before departure: 75%.
Between 0 and 3 months before departure: 100%.

Cancellations commence from the date written confirmation is received by us.  Please note that if the reason for cancellation falls within the terms of any insurance policy, which you may hold, then the insurance company will normally refund any such charges to you.

A charity or company who confirm and book a ride for a particular year but then fail to confirm a date will also forfeit 100% of the ride fee and, unless agreed with Just Pedal Ltd, will not be entitled to move the event to another year.

7. Your Contract with Just Pedal Limited
Your contract is made on these terms and conditions, which are governed by English Law, and you agree to admit to the jurisdiction of the English courts.

8. Insurance
We insist that all clients travelling with Just Pedal Ltd are properly covered from the time of booking with adequate travel insurance which may, if called upon, cover cancellation or curtailment, medical expenses, personal liability, loss of personal effects and luggage, certain benefits in the event of death, loss of limbs, eyes etc.

9. Rider Recruitment and Agreements
Rider recruitment is the responsibility of the organisation or charity (although Just Pedal will always offer assistance in this). All obligations and responsibilities and agreements are between the rider and the charity or organisation. We would strongly recommend that an official agreement is entered into between the rider and the charity or organisation that includes a minimum fundraising requirement where appropriate. This agreement should also cover other issues, for example if a rider is unable to compete for any reason. Just Pedal are unable to offer any refunds or price reductions to the charity or organisation if a rider withdraws.

By entering and participating in any Just Pedal event or training ride you must be aware of and follow our Rules and Regulations. By entering you are confirming that you have read and understood them and that you agree to abide by them.


Rules and Regulations for Just Pedal events

All riders must be 18 years or over on the start date of the event.

Approved safety cycling helmets must be worn for the full duration of the event and by all riders.

It is up to the rider to familiarize themselves with the event schedule and timings as the event will not be delayed if a rider fails to be in the right places at the right times.

If for reasons of safety or the smooth running of the event you are requested to ride in the Support Vehicle for a time, you must comply. Not doing so could result in disqualification from the event.

Riders will follow group riding etiquette at all times and not endanger themselves or their fellow riders. See our Rider Handbook for more information on this.

Riders must seek medical advice if they are unsure about their fitness or have health concerns. It is the responsibility of the rider that they are fit at the start of the event or training ride.
Riders must inform the Ride Managers or Support Team if they feel unwell.

Only road or hybrid bikes are permitted for Just Pedal events. Bikes must be in safe working order for the start of event.

Riders may not deviate from the official route and must obey the local traffic regulations, and traffic officers.

Riders may not use mobile phones MP3 players/Ipods while riding.

Just Pedal events will take place regardless of bad weather and will only be cancelled, re-routed or stopped for reasons of safety. Entry fees are not refundable, however.

Entry to the Event is at the discretion of Just Pedal directors and riders agree to abide by the Bye Laws and Technical Regulations of British Cycling.

RIDER WAIVER AND INDEMNITY

Riders hereby acknowledge that they take part in Just Pedal events, training rides, and all events, functions and activities related to these events entirely at their own risk.

Riders agree for themselves, their executors, administrators, heirs, next-of-kin, successors and assigns to waive release and discharge and shall neither have nor institute any claims whatsoever against Just Pedal and its directors, employees, volunteers, freelancers, trustees and shareholders, local provincial and national governmental authorities, event sponsors, charities, and other involved organisations and their employees, volunteers, agents or contractors to the fullest extent permissible under the Unfair Contract Terms Act 1977 or any other applicable law.

Riders hereby indemnify and hold harmless the organisers, sponsors, charities and their employees, agents, volunteers or contractors from all liability and claims made by other individuals or entities as a result of any of the Rider’s actions during an event.

This waiver and indemnity covers death, disability, personal injury, damage to and loss of property of a participant (including theft of or damage to a bicycle) and is effective whether or not such death, injury, damage or loss may have been caused directly or indirectly or wholly or partly by any act or omission including negligence, of any of the organisers, charities or sponsors and their employees and will bind the heirs, executors and/or trustees of the estate of a rider.

Should liability be found to exist in respect of any one of the organisers, sponsors, or charities for any reason then that liability shall not exist in respect of the other organisers, charities and sponsors unless specific grounds exist for liability on their part.

DECLARATION

I have read and agree to abide by the Terms & Conditions, Rules and Regulations and Rider Handbook for Just Pedal events which I understand may change from time to time and is on the web site www.just-pedal.com I have read and agree to the terms of the Waiver and Indemnity above.

I understand that Just Pedal events will involve lengthy strenuous activity and that I need to achieve an appropriate level of fitness in order to participate. Before the start of the ride I’m taking part in, if I have any concerns whatsoever about my physical fitness or health, or any medical conditions that may affect my safe participation, I will consult my Doctor. I certify that I am physically fit and I hereby assume all the risks of participating in the event.
If I experience any pain or discomfort during the Event I will immediately inform the Organiser. I agree to submit to any medical examination diagnosis or treatment administered by a suitably-qualified medic.

Any medical information held by the organisers or charities may be released by the Organiser to such Medics as may be appropriate in the event of illness or an accident on the trip and I hereby consent to such medical treatment as may be deemed advisable and authorise the Organiser to notify my next of kin.

I understand that the Event may be filmed, photographed and recorded and hereby grant permission to the event organizers to use such images and recordings of myself.

I hereby certify that the information provided by me for this Event is true and correct.

Surrey Hills Epic

Format

1. You accept that the event you are entering is not a race in any format. Results will be published for individuals only and anyone considered to be competing against others will be stopped from riding and banned from entering future events.

Conduct

2. You are fully responsible for your actions whilst attending the event. This includes the event centre and during the ride itself. Just Pedal Ltd, do not accept responsibility for your actions nor their consequences.

3. Upon signing the Event Registration Form or purchasing an entry, you agree that you understand the style of ride you are entering (Road / Gravel) and you are entering and furthermore understand the arduous nature of the event, the terrain and style of riding. Furthermore, you confirm that you are physically fit and capable of undertaking this challenging event.

4. Upon signing the Event Registration Form you agree to reading and watching all pre-event information and any briefing videos.

Age Requirement

5. The Event Registration Form or purchase of an entry to an event must be completed by a person aged 18 years or over. Evidence of age must be provided on request.

6. Riders under the age of 18 will be allowed to participate in the event with the consent of their parent or legal guardian who must sign the Event Registration Form or purchase an entry on the rider’s behalf. By signing the Event Registration Form or purchasing an entry on the rider’s behalf, you accept responsibility for the actions and consequences of the underage rider.

7. Under 16’s need to be accompanied by an adult who is responsible for them at all times.

8. Riders under the age of 12 on the day of the event will be able to ride any event of their choosing for FREE as long as they are accompanied by an adult who is responsible for them at all times. Proof of age of the child will be required at registration. If the child is NOT Under 12 on the day of the event then they will be required to pay the appropriate charge for participating in the event.

Equipment

9. You must wear a safety-approved cycling helmet complying with latest EN1078, ANSI Z90/4 or SNELL standards during your participation in the event. Any rider not wearing a helmet will not be covered by the event insurance and will be disqualified from the event and could be liable for damages if involved in an accident on that basis. You must accept this as a condition of entry.

10. You confirm that the cycle/bike you are riding for the event and all of your equipment is of a suitable standard and state of trail/roadworthiness, in particular the ability to complete the longest distance and over rough terrain, dependant on the event.

11. We reserve the right to refuse entry to the event to anyone with inappropriate equipment or clothing.

E- Bikes

12. If you wish to use an e-bike at one of our events, it must be fully compliant with UK law – e.g. no “chipped” or overpowered e-bikes. These are considered illegal in the UK and are not allowed at our events.

13. As organisers, we are duty bound to prioritise our resources to deal with genuine first-aid and mechanical issues. Flat e-bike batteries mid-ride are ​not​ considered genuine mechanical issues, rather the predictable outcome of poor planning. Riders with flat e-bike batteries are requested to make their own way to the nearest event Feed Station. It should be noted that we may have to wait until the event is finished and/or there are spare resources to facilitate a pick up from these locations. It is therefore suggested that e-bike riders are (1) familiar with their bike’s battery range, and (2) either carry a charged spare battery with them or stash a spare battery at a suitable point on the route in advance.

14. E-bike riders agree to ride legally, appropriately and considerately at all times.

Gravel /MTB Rides

15. Gravel Rides are a cross-country journey by bike that incorporates a mixture of tracks, trails, lanes, bridleways & roads to create an interesting and challenging route over a variety of terrain and surfaces. The on/off road nature of Adventure Cross routes makes a Cyclocross / Gravel bike the ideal choice but, equally, a Mountain (hard tail, full suss) / Hybrid bike can also be used.

Routes

16. Upon signing the Event Registration Form or purchasing an entry (for yourself or another ride), you agree that you (and any other entrants you are registering) are physically and mentally capable of riding the distance you have chosen. If during the event you decide to change the route or distance, you do so at your own risk.

17. During the event, there will be warning signs at appropriate points on the trails or roads. The absence of these signs does not signal that there are no dangers approaching and it is your responsibility to make a decision regarding whether to ride a section or not. The marking of the route does not necessarily indicate that the trail or road is rideable and you are deemed to make your own decision about whether to proceed on bike, foot or not at all.

18. Any marked route is shown for guidance only and we do not insist that you use the route shown. If you choose to ride a section, it is entirely your own choice. If you choose a different route to avoid obstacles or sections you decide are beyond your capabilities, you do so entirely at your own risk.

19. We reserve the right to shorten or alter the published route at any time. You do not have the right to claim a refund if the route is shortened or altered.

20. If you fail to complete the course for any reason, you agree to return to or call the event centre before the close of the event and report to a member of staff. Not doing so will mean that a search may be organised and the subsequent cost will be billed to you.

Rules

21. You are requested to ride in single file where appropriate and no more than 2 abreast at any time. Please be aware of your fellow cyclists, other road users, and any other traffic and always indicate your intention to stop or change direction.

22. You must adhere to and obey the Highway Code, local bylaws and the laws of England, Scotland, Wales and N. Ireland or other country in which the event is taking place as applicable and extend all reasonable courtesy to other road and off-road users.

23. You must be considerate to other users of bridleways, tracks, byways and public ways when riding off-road. Upon seeing other users, such as horse riders, walkers, farm traffic, and other cyclists, you are required to slow down and pass with care. Where appropriate, you should stop and wait at the side of the route for other users to pass safely.

24. You must not drop or leave any litter on any part of the route but dispose of it responsibly at an appropriate place or bin. Any rider found littering will be disqualified from the event.

25. You are expected to respect the roads, villages and countryside that the events travel through. It should be remembered that this is both a working landscape and home to many communities. If you stop for a comfort break you are asked to do so discretely and appropriately and not to cause any offence to local residents or other riders.

26. In the case of Mountain Bike and Cyclocross events, you are expected to close all gates after you pass unless otherwise instructed. You must not leave a gate open for a rider following behind. Gates should be opened and closed and not vaulted. Any rider causing damage to a gate will be liable for any costs to repair said damage.

27. You will be fully responsible for any fees or costs incurred or arising from an accident either involving or caused by you. This includes, but is not exclusive to, fees from Police, Air Ambulance, Fire and Rescue and the Ambulance service. If the situation arises that you are not capable of making the decision to call the emergency services, you agree that a member of our Team or a member of the public may call on your behalf. In this situation, you still accept the costs and consequences of such actions.

28. You accept full responsibility for any fees or costs incurred or arising from the need for repatriation.

Insurance

29. Participation in the event is at your own risk.

30. Third party insurance cover is provided for all riders during the event, covering claims resulting from accidental damage to third party property. This insurance cover is adjudged void if it is deemed the rider has acted negligently. No further insurance cover is provided by us for riders participating in an event.

31. We strongly recommend each rider organises their own personal insurance cover.

32. It is a condition of entry for events outside of the United Kingdom that you have purchased a suitable level of travel insurance to cover the potential activity and liability involved.

Recordings and Event Photography

33. By participating in the event, you confirm and agree that we and third parties authorised by us may record you via photographs, film, audio, audio-visual or other recording, still or moving, during the event (“​Recordings​”). We shall own all rights in such recordings and you hereby (i) assign to us any and all present and future copyright, performance rights and any other right, title and interest in and to the Recordings and you hereby waive the benefit of any law known as “moral rights”; (ii) agree that we may use the Recordings for any purpose at our sole discretion including in any marketing and/or publicity materials, and on any website and social media; and (iii) agree that the Recordings may be altered, edited and/or modified (e.g. combined with other images, text, graphics and/or sound). You hereby release us from any and all liability from such use and promotion and specifically waive any right to any compensation you may have for appearing in any of the Recordings.

34. The ‘Recording’ (photographs, film, audio, audio-visual or other recording still or moving taken during the event) rights remain the property of Just Pedal and the photographer. Whilst we allow riders to download and share recordings free of charge, anyone looking to use the images for commercial purposes needs to contact Just Pedal to arrange special permissions.

35. Whilst we endeavour to ensure that as many riders as are captured in our Event Photography as possible, we do not offer individual rider photos and do not guarantee that there will be a photo of everyone.

Cancellations

36. Event entry fees cannot be refunded under any circumstances.

37. Event entries can be transferred between our events OR to another rider subject to a £5 transfer fee up until 7 days before the original event is due to take place.

38. We reserve the right to cancel any event due to extreme weather conditions. Your entry will be automatically moved to the rescheduled event. If you can’t make the rescheduled event, you can carry your entry to another event of an equal or lower ticket value within the 12 months following the rescheduled event. No refunds will be issued and no compensation will be given towards your travel or accommodation costs.

Promotions

39. In the case of competition entries or giveaways, the winner agrees to the use of his or her name, photograph and disclosure of county of residence and will cooperate with any other reasonable requests from us relating to any post-winning publicity.

40. We reserve the right to remove any Just Pedal or Third Party promotions at any time. You do not have the right to then claim a refund or a voucher for the monetary value of the promotion.

Bike Hire

  1. Disclaimer: Just Pedal Limited accepts no responsibility for damages caused directly or indirectly from the use of this bike. The bike is NOT insured. The customer uses this bike at their own risk.
  2. Use by third party: It is prohibited to pass on this bike for use by a third party.
  3. Reporting Damages: Any damages must be reported immediately. The customer

must cover any outstanding repair costs! Accidental damage caused by a third party, in addition to costs arising from loss, embezzlement or theft must also be covered by the customer.

  1. All bike hire bookings are non-refundable but can be transferred to a different person and/or date.  You can also transfer to a different bike.
  2. Handover/Return: The customer should carry out a thorough bike check during

the handover procedure. We must be notified of any potential defects at this time.

By accepting the agreement the customer declares that the test bike is in suitable working order. The bike must be returned within the allocated time period.
I furthermore give Just Pedal Limited permission to take photographs or video of me and to use the photographs, video or audio in its print and Internet publications or productions, including advertising, signage and promotional materials, and for commercial purposes. I assign all right, title, and interest I may have in any photograph or video to Just Pedal Limited.

 

 

WWW Cycle to the Beginning

By signing-up to ride for the Cycle to the Beginning challenge, you’ve committed to raising a minimum of £5000 for the World Wide Web Foundation (this is per person). We ask that you have 60% of this (£3000) banked with the World Wide Web Foundation by 4 weeks before the event – Friday 12 August 2022. The remaining 40% (£2000) will need to be banked with the World Wide Web Foundation by 4 weeks after the event – Friday 7 October 2022. Although we’re sure our regular communications will guide you towards having 60% banked by the deadline, please make sure you plan and keep an eye on your fundraising efforts to ensure this is met.
